Japan seeks exemption on U.S. sanctions on Iran-Nikkei

TOKYO (Reuters) - Japan is seeking an exemption from proposed new U.S. sanctions against Iran that could effectively freeze Tehran's use of payments for oil, the Nikkei business daily reported on Tuesday, citing sources.

Japanese Finance Minister Koriki Jojima asked U.S. Treasury Secretary Timothy Geithner at an October 11 meeting in Tokyo for the United States to exempt Japanese banks, the daily said, citing unidentified sources familiar with the matter.

Geithner said the matter was being considered, the Nikkei said.

Japan, the world's third-largest importer of crude oil, has already secured waivers from U.S. financial sanctions imposed last year because it has significantly cut purchases from Iran.

A Japanese government official who declined to be identified played down the Nikkei report.

"It is not my understanding that America is currently working on new sanctions or that (Japan) is seeking an exemption from its application," the official said.

The U.S. Congress overwhelmingly passed a new package of sanctions against Iran in August that aim to punish banks, insurance companies and shippers that help Iran sell its oil.

The bill builds on oil trade sanctions signed into law by President Barack Obama in December that, along with EU prohibitions, prompted Japan, South Korea, India and others to slash their purchases of Iranian oil allowing them to get waivers from Washington.

The West has imposed sanctions on Iran because it suspects it wants to develop nuclear weapons. Iran says its nuclear programme is for civilian purposes.

FREEZE

Other importers of Iranian oil besides Japan are also likely to voice their opposition to the proposed new sanctions, the Nikkei said.

U.S. lawmakers are considering expanding economic sanctions on Iran - measures that already have helped push that country's currency into free fall but have not yet convinced it to abandon its nuclear programme.

Democratic Senator Robert Menendez, a member of the Senate Banking and Foreign Relations Committees, has said he is looking at ways to freeze an estimated 30 percent of Iran's foreign currency reserves held in banks outside the country.

Currently, Japanese buyers of Iranian oil pay Iran for crude imports in yen via accounts set up at Japanese banks by Iran's central bank, and the funds later get transferred to Iran's private banks.

But the proposed new U.S. sanctions would effectively freeze those assets, and if the measures are implemented, Iran would no longer be able to use Japan's oil payments freely, which could further curb Japan's oil purchases from Iran, the Nikkei report said.

The United States is set to implement the new sanctions from February, the report added.

In the first eight months of 2012, Japan imported 191,731 barrels per day of Iranian crude, down more than 40 percent from the same period a year ago, according to Reuters calculations based on data from the Ministry of Economy, Trade and Industry (METI).

The ministry is due to release import figures for September on Wednesday.

Queen's University scientist, Dr Ryan Donnelly, has been named the 2012 GlaxoSmithKline Emerging Scientist for his research on microneedle-based systems which deliver drugs without causing pain or bleeding.

Dr Donnelly, Reader in Pharmaceutics in the School of Pharmacy at Queen's, beat off competition from around the world to scoop the award for his work which has taken the sting out of medicine delivery and monitoring.

The award is presented annually to scientists from across the globe who have demonstrated a substantial advancement in the application of scientific knowledge within the pharmaceutical sciences through published work over the last five years. The winner is chosen by a Panel of Senior Staff from GlaxoSmithKline (GSK) and work is judged on scientific quality and the actual or future applicability to industrial practice.

Dr Donnelly was presented with the accolade by GSK Vice President Jo Craig and delivered his award lecture at the Academy of Pharmaceutical Sciences UKPharmSci 2012 conference, which was held in Nottingham.

Pro-Vice-Chancellor for Research and Postgraduates, Professor James McElnay, said: "This award is further recognition of the quality and impact of Dr Donnelly's work. It demonstrates the high regard with which the ground-breaking research being conducted at Queen's is held on both a national and global level.

"Dr Donnelly's research on microneedle-based systems has the potential to change the future of drug delivery and monitoring. I am pleased to congratulate him on his award as the GlaxoSmithKline Emerging Scientist of 2012."

Speaking about his research, Dr Donnelly said "If you look at a microneedle patch with the naked eye, you can see that it is slightly rough. If you run your finger across it, it feels like Velcro. However, when properly applied, the microneedles puncture the outer layer of the skin without causing pain or bleeding. These tiny needles then swell, allowing controlled administration of even large medicines like insulin, as well as vaccines. Skin fluid can also be collected and we believe that analysis of this fluid will enable frequent, accurate, pain-free monitoring of the levels of medicines in the body. This application could prove to be particularly important in enhancing medical care for premature babies".

Speaking about his award, he said "This award is a nice recognition of the hard work my Group has put in over the past few years. We have secured a number of significant grants from BBSRC, EPSRC, The Wellcome Trust, the Royal Society and Action Medical Research and have contributed numerous publications to the microneedle field, including the first textbook on the subject, published this year by Wiley. Our microneedles technology is attracting considerable interest from industry, with a number of co-development projects already underway in a wide range of fields of use."

Five Things Leaders Can Learn from Mayor Bloomberg About Crisis ...

While the impact of Hurricane Sandy in the U.S. spread far and wide, the New York/New Jersey area definitely took the worst hit. The scenes of flooding, fires and dangling construction cranes on Monday night and Tuesday morning were truly stunning.

In the run-up to the storm, a friend of mine wrote that we were likely to see lots of examples of leadership this week. She was certainly right. Some dramatic examples that come to mind are the U.S. Coast Guard?s helicopter borne rescue of the HMS Bounty crew off North Carolina (see the video here) and New York City firefighters rescuing residents from a waterlogged inferno in Rockaway, Queens.

A less dramatic but equally visible example of leadership this week has come from New York City mayor Mike Bloomberg. With multiple press conferences a day before, during and after the storm, Bloomberg has kept his citizens informed and, in the process, given a seminar on how to do leadership communications in a crisis. If you haven?t seen one of the mayor?s press conferences, it?s worth a look to see how he does it. I?ve watched excerpts from a few of them today and read through some of the transcripts.

Here are five lessons I?ve learned about crisis communications from Mayor Mike:

Project Quiet Confidence: As I?ve written here before (long before Hurricane Sandy), leaders create the weather; not literally obviously, but leaders influence the response of others by how they show up. In all of his briefings, Bloomberg showed up prepared, appropriately concerned and quietly confident that his extended team and his citizens would respond to the storm in the most effective way possible. His quiet confidence likely gave confidence to others in a challenging situation.

Be Consistent and Frequent: I don?t know the exact schedule that Bloomberg has had for his pressers but it looks like he was up for 20 to 30 minutes in the morning and afternoon each day before, during and after Sandy. Establishing an operating rhythm for his communications enabled him to get his team?s messages out consistently. Keeping people informed helps keep them calm.

Be Relevant: Bloomberg and his staff have done a masterful job of talking about the things that matter most to people. He?s kept his remarks relevant by providing information on preparation plans, evacuations, when the power will be back on, transportation updates and even the plans for Halloween post-Sandy.

Make Specific Requests: In a crisis, most people want to know what they can do to help or at least stay safe. (Then there are those who ignore all the requests at the peril of themselves and others.) Bloomberg has been very clear in asking people to do things that help themselves and the community ? evacuate low lying areas, stay out of public parks until damaged trees are cleared, only use 911 for life threatening emergencies. Most people will honor specific, common sense requests. Leaders communicating in a crisis need to make them.

Put the Team Front and Center: In every press conference I saw, Bloomberg had the leaders of the relevant city agencies lined up behind him. They were there to answer questions but also to demonstrate that there was a unified effort to address the challenges at hand. Bloomberg went out of his way to recognize specific leaders and their agencies for the work they were doing. In a crisis, people want to know that qualified people have their backs. Bloomberg made sure that New Yorkers knew that.

Wine & Spirits to Reopen Wednesday After Superstorm Sandy ...

Pennsylvania Wine & Spirits stores are set to reopen at as scheduled on Wednesday, according to state spokeswoman Stacy Kriedeman.

The Sewickley store normally opens at 9 a.m. Monday through Saturday and noon on Sunday.?

State stores closed early Monday at 3 p.m. ahead of Superstorm Sandy.

Game On Dude made early favorite for Breeders' Cup

(AP) ? Game On Dude was made the early 9-5 favorite in a field of 12 for the $5 million Breeders' Cup Classic, a race he led most of the way last year before being overtaken in the closing strides. This time, he'll have home-field advantage running at Santa Anita, where the 5-year-old gelding is 5-0.

He will try to deliver a first-time victory in the Classic for Hall of Fame trainer Bob Baffert, who holds a strong hand heading into the two-day, $25 million world championships. Baffert has finished second twice, including last year.

"He's a better horse this year," Baffert said Monday, when Game On Dude drew the No. 5 post for the 1 1/4-mile Classic. "He seems more relaxed. He's getting better with age."

Baffert is taking two shots at winning the $2 million Juvenile with Power Broker and Title Contender. They'll be facing stiff competition in undefeated Shanghai Bobby, the 2-1 favorite trained by Todd Pletcher. The Juvenile winner is typically tagged as the winter favorite for the Kentucky Derby.

Shanghai Bobby was one of nine New York-based horses scheduled to arrive Tuesday, but the flight has been pushed back to Wednesday because of superstorm Sandy, which slammed into the New York metropolitan area Monday.

Game On Dude, co-owned by retired Los Angeles Dodgers manager Joe Torre, heads a field of 12 for the Classic. With Rafael Bejarano replacing Chantal Sutherland in the saddle, the gelding will try to win after getting beaten by Drosselmeyer last year at Churchill Downs.

Flat Out and Whitney winner Fort Larned were the 5-1 co-second choices. Ron the Greek was made the 6-1 third choice.

Trainer Bill Mott, who swept the Ladies' Classic and the Classic last year, is saddling three horses in Saturday's Classic ? Flat Out, Ron the Greek and To Honor and Serve, the 8-1 co-fourth choice with Mucho Macho Man. Flat Out drew the No. 2 post; Ron the Greek got post 10; and To Honor and Serve got post 12.

"Perfect," said Mott, who was on his way from New York via Miami on Monday. "They're good. The post positions are fine."

In the Juvenile, Shanghai Bobby will be ridden by Rosie Napravnik, who has been aboard for each of the 2-year-old colt's four victories this year. She could join Julie Krone as the only women to win a Breeders' Cup race in the event's 28-year history. Shanghai Bobby will face eight rivals in the 1 1/16-mile race.

Royal Delta, the defending Ladies' Classic champion trained by Mott, sustained a minor cut on her right thigh while being loaded on a flight from upstate New York on Monday. He said the cut was stitched up and she should be fine.

"It's no different than a hockey player getting a little cut on his forehead and getting stitched up," Mott said. "They're athletes."

Royal Delta was entered in the Ladies' Classic instead of running against the boys in the Classic on Saturday. She is the 9-5 favorite under Hall of Fame jockey Mike Smith, who won last year's Classic on Drosselmeyer.

Awesome Feather, undefeated in 10 career starts, was the 3-1 second choice; undefeated My Miss Aurelia and Britain-bred Questing were the 4-1 co-third choices in the field of eight.

Royal Delta was among 17 horses arriving Monday after their flight was moved ahead eight hours to a 1 a.m. EDT departure to beat Sandy. The flight was moved from an airport on Long Island to Newburgh, N.Y., to avoid strong winds ahead of the storm.

Trainer Dale Romans said Pacific Classic winner Dullahan will run in the $3 million Turf rather than the Classic, where he had been pre-entered. Arlington Million winner Little Mike, also trained by Romans, will go in the Turf after being considered for the $2 million Mile.

The world championships open Friday with six races. Louisville basketball coach Rick Pitino owns South Floyd, who drew post four in the seven-horse $500,000 Juvenile Sprint.

New Orleans Saints quarterback Drew Brees co-owns Worth Repeating in the $500,000 Marathon, which drew a full field of 14.

Saturday's nine races include the $1 million Turf Sprint, with Mizdirection among the 16-horse field. He's co-owned by sports talk radio host Jim Rome.

Bomin Linde JV to Build LNG Terminal for Ship Fuelling in Port of Hamburg

Starting point for the Bomin Linde LNG GmbH & Co. KG: The first project is the construction of a liquefied natural gas terminal intended to provide ships with the cleaner fuel in the Port of Hamburg. This is based on the successful completion of a feasibility study conducted by the Hamburg Port Authority and Linde.

Shortly after its establishment, the Bomin Linde LNG GmbH & Co. KG has been concentrating on the implementation of initial projects to build storage and refuelling infrastructure for liquefied natural gas (LNG) in several European ports. The first specific step taken by the joint venture of Linde Group and Bomin , a subsidiary of the Marquard & Bahls AG, is the construction of a terminal for fuelling ships with LNG in the Port of Hamburg. Potential ways of implementation are presently being evaluated in order to comply with the legal approval criteria necessary to set up a so-called small scale LNG terminal on the Marquard & Bahls subsidiary Oiltanking premises in the Hamburg port.

Thanks to economic and eco-political developments, LNG has a very promising future as an alternative ship fuel. As of 2015, the limits on sulfur emissions will be reduced significantly for shipping in the North and Baltic Seas. On the one hand, LNG offers the ship proprietors and owners the opportunity to sustainably fulfill the new emission standards while simultaneously reducing the operational costs of their ships. On the other hand, the Port of Hamburg will have the opportunity to gain a pioneering role in the introduction of LNG as an alternative ship fuel in Europe.

?The shipping industry is very eco-friendly measured by the emissions per tonne kilometer? is stated by Frank Horch, Hamburg?s Senator of Commerce. ?Nevertheless shipping is also facing stricter requirements in terms of environmental conservation: Sulfur content in fuels will globally be limited. The Bomin Linde Joint Venture?s activities are an auspicious occasion for our port. We are hereby sending out a strong signal that we are taking sustainability seriously in Hamburg.?

Hamburg Port Authority (HPA) has already recognized this great opportunity and, together with Linde Group, has taken the initial step by successfully conducting a feasibility study on the construction of LNG infrastructure.

?The Port of Hamburg has set itself the task of bringing economy and environment al protection in line. In this context, the use of LNG represents an important step forward?, states Jens Meier, Managing Director of HPA.

The Hamburg Port Authority is not only a supporter for creating the necessary conditions, but rather also wants to become one of the first LNG users: HPA plans to be operating a vessel running on LNG technology by 2014.

On Nov. 30, 2006, the Hales family of the Marblehead Ward, San Clemente California Stake, gathered around 5-year-old Chase. His two older sisters came to spend time with him in case he did not survive surgery to remove a brain tumor. He held tightly to a toy they had given him as he was taken back into surgery.

Chase Hales, now a healthy 11-years-old, shows off his skateboarding skills. The Hales Family created a day of service to express gratitude for the life of their son, a tumor survivor, and help others celebrate the gift of life.

"I think I got it all," breathed a relieved Dr. William Louden an hour and a half later.

Before the surgery, Dr. Louden, Chase Hales' pediatric neurosurgeon at Children's Hospital of Orange County, told Sloan and Stephanie Hales he was "choosing to be optimistic" about the complex surgery to remove a medullablastoma (malignant brain tumor) apparently entrenched in the top of their son's spinal cord. The surgery went more smoothly than planned: the tumor came out easily and in pieces.

"The type of tumor that it was, it's the kind you'd want to order," said Sister Hales. "Academically, socially, physically, it was almost perfect timing if you're going to have a brain tumor."

Through divine intervention, the tumor was discovered just in time. The fluid on Chase's brain had been building up for two to three weeks; had it been discovered any later he might have died, according to Dr. Louden, his neurosurgeon.

"Even now, I am amazed at the grace that Heavenly Father showed us," Sister Hales said in an email. "I marvel that Chase's symptoms had to get bad enough that my husband and I could not ignore them, but not bad enough to kill him, in order for him to be properly diagnosed. Had we called the doctor even weeks before, Chase probably would have just been prescribed anti-nausea medicine and/or anti-anxiety medicine because he exhibited no other alarming symptoms."

Chase was also fortunate in that his subsequent treatment took place as part of a five-year study. At random, he was selected to receive more chemotherapy and less radiation, leaving him with fewer side-effects.

Sister Hales ascribes Chase's miraculous diagnosis and smooth recovery to priesthood blessings, the faith and prayers of others and people following promptings.

"Our family, thankfully, has been able to turn our fears about Chase into hope and then gratitude. Anyone can do that," Sister Hales said. "I know that Heavenly Father gave us the strength and comfort we needed when we were uncertain and weak."

The Orange County Foundation took care of the family after Chase's diagnosis and sent the family to a camp for families of cancer victims, free of charge. In order to give back and raise awareness of OCF and other non-profits, Sister Hales instigated an annual day of giving to encourage people to find a way to give to self and others and celebrate being alive. She hopes the Day of Giving will gain momentum as things move forward. The first Chase Hales Family Day of Giving coincided with California's coastal cleanup day. Sister Hales designed the day to be something anyone can participate in, anywhere in the world. More than 800 volunteers gathered for a beach clean-up effort on Sept. 15 and more than 11,000 people shared the event on Facebook.

"I want my children to have something they can be proud of," Sister Hales said.

Over a period of 10 days, Sister Hales and her oldest daughter used left over paints to restore and detail a faded map of the United States at Chase's school. This map has become a fun play place for children at Marblehead Elementary. Sister Hales said she is happy her family is involved with service and is optimistic her children will continue with this legacy.

Israel arrests Hamas activists in West Bank

JERUSALEM (AP) ? Israel's intelligence service has arrested dozens of Hamas members in the West Bank who had been setting up infrastructure for the militant Islamic group there, according to a statement Monday.

In Hamas-controlled Gaza, militants fired volleys of rockets and mortars at southern Israel, triggering an Israeli airstrike.

The Shin Bet said that 30 Hamas members were arrested near Ramallah, the West Bank's administrative center. It said they were setting up a Hamas network in the West Bank and were relaying information to the overseas leaders of the group, which is sworn to Israel's destruction. They were also setting up Hamas cells in West Bank schools, the statement said.

The statement said two of those arrested were involved in the murder of two Israeli soldiers by a Palestinian mob in 2000. The soldiers entered Ramallah by mistake and were taken to a police station, where they were tortured and then thrown out of a second-story window.

Hamas violently took over Gaza in 2007 in bloody street battles from the rival Palestinian group Fatah.

The Palestinian Authority, dominated by Fatah, has limited powers in the West Bank under Israel's overall security control and has launched its own crackdown against Hamas.

Israel and much of the West deals with the Palestinian Authority, while shunning Hamas, labeling it a terror group due to its suicide bombings and other attacks on Israel that killed hundreds of civilians.

Also Monday, Israeli aircraft struck a Palestinian rocket launching pad and an unidentified militant activity site in the Gaza Strip, in response to persistent rocket and mortar fire from the coastal territory, the military said.

Gaza militants launched 21 rockets and mortars into southern Israel earlier in the day, according to the military's count. No casualties were reported on either side.

The hostilities threatened to undercut a brittle, informal truce that went into effect last week after the worst outbreak of violence between the two sides in months.

Military aircraft dropped leaflets over Gaza warning Palestinians to stay away from the border fence with Israel or risk drawing fire.

The leaflets also warned civilians not to cooperate with militants, dig smuggling tunnels or smuggle in weapons.

Hamas police scooped up the leaflets, witnesses said.

Zombies Invented In Buffalo?

Mark Twain was living in Buffalo for awhile. One of the stories he wrote in?1872 while he was here was called "A Curious Dream"--a story about?corpses rising?from the dead and walking. Is Buffalo the birthplace of Zombies used in?entertainment form?

The earliest zombie walk on record was held on August 19, 2001, in?Sacramento, California. The event, billed as "The Zombie Parade," and the?idea spread to other cities, and in October 2003 the second zombie gathering?on record, billed as a "Zombie Walk," was held in Toronto, Ontario

In 2009 Terror Technologies started looking into the Zombie craze--right?after our Free Haunted House for Charity wrapped up for the season. We were?looking for a way to promote our Charity Haunt year-round when we got?together with Mark Madden of Maddtat2 & Madd Tiki Tattoo in April of 2010?and held the first official Buffalo Zombie Walk for Charity & Pub Crawl?just 2 months later on July 10, 2010.

The Food Bank of WNY contacted me about being part of the event and not?only did they join us they also put us in their Food Drive Music Video,?which is shown prior to every movie in Dipson Theaters across WNY. We have?had a great working relationship with the Food Bank of WNY ever since and?have collected tons of food for them. Now we also work with Make-A-Wish,?Hearts for the Homeless, and UNYTS on a regular basis.

The Buffalo Zombie Walk & Pub Crawl for Charity was the very first combo of?a Walk & Pub Crawl to be held the same day back-to-back in the world. We?also formed what is now called the Terror Tech Zombie Blood Crew because of?this event. People of all walks of life join us in our mission to make a?difference in WNY--one event at a time. Soon after, we were being invited to all?kinds of events, parades, fairs, and festivals--to the point where we?can be seen?almost every weekend somewhere in WNY dressed up as Zombies.

I had no idea that we would be what we are today. I can honestly say we?have taken WNY by HORDE, wherever we go now we are recognized and?thanked for relentless hard work in raising awareness and helping the?community--from charity foundations to the complete strangers we helped?throw benefits for to cover medical expenses to doing thousands of free?zombie make-up for whoever wants it at events. We just want to make people?smile and forget about the daily grind some of us are caught up in. Who knew?dead people would be the hit of the party!

Today we stand up proud (well as much as a Zombie can) knowing we have?made Zombies & Charity work go hand-in-hand not only in WNY but across the?world. I have people worldwide who ask for guidance on throwing a Zombie?Walk in their hometown, and almost everybody is tossing in a charity to?benefit from it.

SpaceX capsule lands after historic mission to Space Station

NASA's first commercial cargo flight ended with a splash on Sunday, when the SpaceX Dragon capsule landed after a landmark mission to the International Space Station.

The unmanned Dragon space capsule, built by the U.S. company Space Exploration Technologies (SpaceX), splashed down into the Pacific Ocean off the coast of Southern California at 3:22 p.m. EDT (1922 GMT), ending a three-week visit to the orbiting laboratory.

Dragon began its descent with a de-orbit burn at 2:28 p.m. EDT (1828 GMT), after departing the station at 9:29 a.m. EDT (1329 GMT) as both spacecraft sailed 255 miles (410 kilometers) above Burma. The station's crew used the outpost's robotic arm to release the spacecraft.

"It was nice while she was on board. We tamed her [and] took her home," space station commander Sunita Williams of NASA radioed Mission Control in Houston as the Dragon capsule departed. "Literally and figuratively, there are pieces of us on that spacecraft going home to Earth."

The Dragon capsule is returning hundreds of astronaut blood and urine samples from the space station amid the 1,673 pounds (758 kilograms) of experiments and gear loaded on board. Some of those samples have been waiting for more than a year. NASA's final space shuttle mission landed in July 2011, leaving the agency without a way to return big cargo deliveries to Earth until Dragon's flight.

The spacecraft is expected to be retrieved by a SpaceX recovery crew so the cargo can be delivered to NASA. The mission is the first of 12 commercial resupply flights by SpaceX under a $1.6 billion deal with NASA.

The Hawthorne, Calif.-based SpaceX (short for Space Exploration Technologies) launched the Dragon capsule toward the space station on Oct. 7 using one of the company's own Falcon 9 rockets and a pad at Florida's Cape Canaveral Air Force Station. The capsule was packed with 882 pounds (400 kg) of supplies to for the station, including 260 pounds (117 kg) of crew gear, 390 pounds (176 kg) of scientific equipment, 225 pounds (102 kg) of hardware and several pounds of other cargo, NASA officials said.

The cargo returning home on Dragon are 163 pounds (74 kg) of crew supplies, 866 pounds (392 kg) of scientific research and 518 pounds (235 kg) of other hardware, they added. ?

SpaceX is the first robotic spacecraft ever to be capable of returning cargo to Earth.

"It has been an historic mission," NASA spokesman Josh Byerly said during undocking commentary. ?

The unmanned cargo ships built by Russia, Japan and Europe are all designed for one-way trips and are intentionally destroyed during re-entry at the end of their missions. The Russian Soyuz capsules that ferry crews to and from the space station have limited cargo return capabilities, NASA scientists have said.

SpaceX was founded by billionaire entrepreneur Elon Musk in 2002 as a private spaceflight company. In May, the company launched its first Dragon capsule test flight to the space station to set the stage for this month's first cargo delivery flight. The next Dragon cargo mission is slated to launch in mid-January.

SpaceX is one of two companies with deals to launch cargo delivery flights on unmanned spacecraft for NASA. The other company, Virginia's Orbital Sciences Corp., has a $1.9 billion contract with the agency for at least eight missions to the station using the new Antares rocket and Cygnus spacecraft. The first Antares test flight is set for later this year.

With its space shuttle fleet retired, NASA is relying on the Dragon and Cygnus spacecraft to ferry U.S. supplies to and from the International Space Station. The space agency is also supporting the development of new commercial U.S. spacecraft to launch American astronauts on space station trips.

SpaceX is one of four companies currently developing manned private space taxis with NASA funding support. The company is upgrading its Falcon 9 rocket and Dragon capsules to eventually launch crews of seven astronauts into orbit.

Hurricane Sandy is kicking up big waves along South Carolina as it heads north, where forecasters say it will likely hit two winter weather systems, creating a hybrid monster storm.

Residents in the storm's path are boarding up windows and stocking up on supplies before Sandy's predicted landfall early Tuesday near the Delaware coast.

Estate planning: Who gets the house? | Inheritance ... - Financial Post

All of the sudden, the second person?s children are disinherited from their natural father or mother?s assets

There?s a good chance it?s the single most valuable asset you own. It doesn?t take much imagination to think your heirs are going to want it after you are gone.

The fight for your home is likely to be all the more messy in this day and age as second marriages become more mainstream, leaving adult children to battle with step parents for an asset that may have doubled in value over the last decade.

A Statistic Canada report released in September found a higher divorce rate has led to a greater likelihood of a second marriage and, with that chance of remarriage, comes the major issue of deciding on who owns the matrimonial home.

?The family unit is changing,? says Raymond Leclair, vice-president of public affairs at LAWPRO (Lawyers? Professional Indemnity Company). ?The issue becomes then how do people own their home.?

Traditionally, a couple owned their home together and when one parent died, it went to the other spouse. When the remaining parent died, all that wealth went to the kids.

With that ?natural progression,? says Mr. Leclair, you are creating a potentially explosive situation with second spouses.

For instance, stick with the old standard of a joint tenancy agreement where the surviving spouse gets the house, where does that leave your kids if that?s your second spouse? ?In joint tenancy, you own an equal undivided tenancy and the survivor gets the full title,? says Mr. Leclair. ?You have to think where this is going.?

For a couple on their second marriage, a better option may be a tenancy-in-common ownership solution where the couple choose the ownership split on a property. Each parent can then have their share of the property go to whoever they want, including children from a previous marriage.

?There is nothing that obligates you to keep a will forever,? says Mr. Leclair, about agreements spouses may make to pass on wealth to children from another marriage. A surviving spouse who got the whole house can update their will later on, he notes. ?All of the sudden, the second person?s children are disinherited from their natural father or mother?s assets.?

The situation could become even more contentious if the deceased spouse is the one who paid for the house or did most of the upgrades with the surviving spouse inheriting it all. And the rules apply to everything set up in joint tenancy, including the family cottage or vacation home.

But you can retain control of your home from the grave if you carefully set up ownership well in advance of your death.

Leanne Kaufman, vice-president of the professional practice group at RBC Wealth Management, said fights over the house are mitigated when potential beneficiaries are considered elsewhere as part of estate planning.

She says anything jointly held with right of survivorship will go directly to the other person ? a tactic people use to avoid probate fees. ?Someone has told them probate fees are bad and joint accounts are good but they may not understand the impact,? says Ms. Kaufman. ?In the grand scheme of things [probate] is not that bad.?

An issue for anybody should be taking care of their spouse after their death, so other problems are not created.

?In Ontario, there are provisions that on your death your spouse says I don?t want what I was given under the will, I want a family property claim,? says Ms. Kaufman, about a surviving spouse going after the home. ?It?s the same claim someone can make if they had separated from their [spouse] six months before [their death].?

You also have consider whether you want to create a situation where your grief-stricken spouse is forced to leave the family home just to clean up an estate.

?I recommend that the surviving partner be given a right for a finite period of time, say two years, to find replacement living arrangements, that allows the separation of the children from the surviving step-parent. That usually is best for everyone,? said Paul Hood, author of Estate Planning for the Blended Family.

Mr. Hood said you need consider such things as maintenance, taxes and other costs associated with a home. ?Otherwise, it can be a war. These types of arrangements can be very problematic unless the deceased partner planned well and left enough liquid assets to allow the surviving partner to pay the regular upkeep and real estate taxes,? he says.

Jason Heath, a fee-based certified financial planner at Objective Financial Partners Inc., says he?s had real life examples where people think they are leaving money to their children but in effect they?ve set up a joint ownership situation with their spouse.

?I had to sit down with a client and tell them ?what you think happens in your will is actually the opposite of what really happens.? They were on their second marriage. There are a lot of mistakes people make about thinking assets will pass through their will,? says Mr. Heath.

The rising value of houses in Canada has made all of this more prevalent today. ?It?s amazing we have people who live on government pensions but they have a $1-million home and a $1-million cottage,? says Mr. Heath.
